These Terms of Use ("Terms") govern access to and use of the Cadência mobile application ("Cadência", "app", "service"), offered by Josafá Melo de Paulo, based in São Paulo/SP, Brazil ("Cadência").

By creating an account, installing or using the app, you ("user", "you") declare that you have read, understood and fully agree to these Terms and to the Privacy Policy. If you do not agree, do not use the service.

1. About the service

Cadência is a platform that facilitates the organization of outdoor training groups — cycling, running, hiking, mountain biking, gravel, trekking and other activities. The app lets you create groups, schedule training sessions, confirm attendance, perform geolocated check-ins at meeting points and share routes.

Important: Cadência is only a communication tool. We do not organize, supervise or take responsibility for any training, gatherings or physical activities scheduled by users. Responsibility for the training and participants lies exclusively with the group organizer and each participant.

2. Minimum age

Use of Cadência is restricted to people aged 18 or older. By using the service, you declare you are 18 or older and have full legal capacity.

3. Account and registration

You may create an account via email/password, Sign in with Apple or Google login.
The data you provide must be true, complete and up to date.
You are solely responsible for the security of your credentials and for all activity carried out on your account.
Notify us immediately of any unauthorized account use.
Each person may maintain only one active account.

4. Acceptable use

When using Cadência, you agree not to:

Use the service for unlawful or fraudulent purposes or in violation of third-party rights.
Post offensive, discriminatory, violent, sexually explicit, defamatory or hate-inducing content.
Engage in spam, phishing or send unsolicited commercial communications to other users.
Attempt to access others' accounts, restricted areas, internal systems or exploit vulnerabilities.
Reverse-engineer, decompile or attempt to extract source code from the app.
Use unauthorized bots, scrapers or automations.
Falsify location (GPS spoofing) to bypass check-ins.
Collect or store personal data of other users without express authorization.

5. Groups and roles

Organizers

Are responsible for the group's content, scheduled training, and member moderation.
May promote, demote, deactivate or remove members per the app rules.
Must ensure that published data, photos and descriptions are appropriate and respect third-party rights.

Members

Agree to respect the rules set by the group organizer.
May leave the group at any time.
Are responsible for the comments and RSVPs they post.

6. Training and physical responsibility

Health warning: physical activities involve risks. Consult a doctor before starting any activity. Cadência does not replace medical advice or professional fitness guidance. Practice within your limits and always use proper protective equipment.

By participating in any training scheduled through Cadência, you:

Acknowledge the activity is organized by third parties — other users of the app — and not by Cadência.
Assume full and exclusive risk involved, including injuries, accidents, property damage or interpersonal conflicts.
Release Cadência from any liability for physical, moral or property damage arising from participation in training.
Agree to comply with traffic, environmental and other regulations applicable to the activity location.

7. Geolocated check-in

The check-in feature requires access to your location exclusively at the moment of check-in, to validate that you are within the radius defined by the organizer at the meeting point. Location is not collected continuously or in the background. Details in our Privacy Policy.

8. User content

You retain all rights to content you post (text, photos, GPX files, etc.). By posting, you grant Cadência a non-exclusive, worldwide, royalty-free, revocable license to display, store and process such content strictly for service operation.

You declare that you have the right to publish all submitted content and are responsible for any violations of third-party copyright, trademark, image or privacy rights.

9. Public training sharing

Organizers may opt to generate a public link for a training session. This link displays basic information (training name, group, date, meeting-point address, routes and banner). It does not expose member data, check-ins, RSVPs or comments. By publishing the link, the organizer authorizes this sharing.

10. Third-party integrations

Cadência may offer optional integrations with third-party services (e.g., Strava). By connecting such services, you authorize the data exchange according to the scope described at the time of connection. Cadência is not responsible for the policies, availability or content of those services.

11. Paid plans and subscriptions (when available)

Cadência may offer paid plans with additional features (e.g., Cadência Pro). When applicable:

Prices, billing periodicity and benefits will be clearly displayed before purchase.
Subscriptions auto-renew at the end of each cycle, unless previously cancelled.
You may cancel at any time. Access remains active until the end of the paid cycle, with no proportional refund, unless legally required.
For subscriptions contracted via App Store or Google Play, cancellation and refund follow those platforms' policies.
Right of withdrawal: within the first 7 days of first purchase, per art. 49 of the Brazilian Consumer Code, unless the service has been effectively used.

12. Suspension and termination

We may suspend or terminate your account, with or without prior notice, in case of:

Violation of these Terms or the Privacy Policy.
Abusive, fraudulent or unlawful conduct.
Prolonged inactivity (after email notice).
Legal or judicial determination.

You may also terminate your account at any time via the "Delete account" option in the Profile. Deletion removes your data as described in the Privacy Policy.

13. Reporting and moderation

To report misconduct, offensive content, problematic groups or suspected fraud, email contato@cadenciapp.com. We will evaluate each case and may remove content or users at our discretion.

14. Intellectual property

The "Cadência" brand, visual identity, source code, interface, texts and other elements of the app are owned exclusively by Cadência and protected by applicable law. These Terms do not grant any license over these elements except the limited right to use the app as provided herein.

15. Limitation of liability

To the maximum extent permitted by applicable law:

The service is provided "as is", with no warranties of uninterrupted availability, error-freeness or fitness for a particular purpose.
Cadência is not liable for indirect damages, lost profits, data loss or harm resulting from use or inability to use the service.
Cadência is not liable for acts, omissions, conduct or content of other users or third parties.
Cadência is not liable for accidents, injuries, physical, material or moral damages occurring during or by reason of training.

These limitations do not exclude consumer rights provided in the Brazilian Consumer Protection Code (Law 8,078/1990).

16. Changes to these Terms

We may amend these Terms at any time. Material changes will be communicated through the app or by email in advance. Continued use of the service after the communication means acceptance of the new versions.

17. Governing law and venue

These Terms are governed by the laws of the Federative Republic of Brazil. The courts of the District of São Paulo/SP, Brazil, are elected to resolve any disputes, with waiver of any other, however privileged.
